Terms Of Service
Customer agrees to the following terms of service:
Orders: We JMHServices may require a service agreement and a picture ID to provide service. We reserve the right to decide what customers will have to provide these and what customers will not. We use these for fraud protection only. We recognizes the importance of protecting your privacy and our policy is designed to assist you in understanding how we collect, use and safeguard the personal information you provide to us and to assist you in making informed decisions when using our services. This policy will be continuously assessed against new technologies, business practices and our customers' needs. Broadly speaking, we use personal information for purposes of administering our business activities, providing the products and services you requested, to process your payment. We will never share your personal information for any reason except to dispute charges and other billing activity.
Non-Payment: All payments are due in full on the monthly anniversary date. Failure to remit payment for services on the monthly anniversary date is a violation of the TOS. Its simple you don't pay we shut your services off. In the case of multiple services by the same customer non-payment of one service will result in suspension of all services of said customer. Now let me say we are easy to get along with if you have a problem email us and I am sure we can work something out. But if no emails are received we will assume you have abandoned the account and it will be removed. JMHservices is not responsible for any data loss due to non-payment suspension. As of Feb 1 2008 there will be a $10 (ten) usd reconnect fee that will need to be paid before any service is restored after suspension of an account for non-payment.
Cancellation: While we at JMHservices pride ourselves on the service we offer we know we can not satisfy every customer every time. We will work with any customer to work out any problems you may have. If we can not work out the problem we will at our discretion refund any monies paid. Other than that all cancellations will result in no refunds. Setup fee's are not refundable under any circumstances.
Data: JMHServices agrees to use best efforts and commercially reasonable best practices when deploying services related to data integrity, backup, security, and retention. These services include, but are not limited to: hard drive storage, raid hard drive arrays, network attached storage, storage area networks, operating system installs, operating system reloads, client area information, and other situations involving customer data. Customer assumes ultimate responsibility for data integrity, retention, security, backup, and ownership.
Bandwidth: Bandwidth runs from the first day of the month to the last day of the month. Bandwidth is measured and logged in a database at the end of the term both inbound and outbound bits are totaled and the total is your monthly bandwidth.
Seed Box FTP: Bandwidth for FTP is currently not counted on the seed box home page. We add this to your total usage every monday at 12:01am GMT so please be careful when you get low on bandwidth.
Bandwidth Overage: is charged at a a rate of .25 (25 Cents USD) per gigabyte of traffic rounded up to the next highest gigabyte. This amount will be billed to you and non payment of the amount within 3 days of billing will be considered breach of TOS agreement and the account and services will be terminated at our discretion.
Disk Space Overage: is charged at a a rate of 1.00 (1 dollarUSD) per gigabyte of space rounded up to the next highest gigabyte. This amount will be billed to you and non payment of the amount within 3 days of billing will be considered breach of TOS agreement and the account and services will be terminated at our discretion.
Acceptable Use Policy
General Statement: JMHServices is dedicated to the unrestricted free transmission of information via the Internet and its many resources. JMHServices is dedicated to protecting the source and distribution of information and protecting the rights and privileges of those utilizing it. JMHServices does not purport to be the content police; our duty in the process of information dissemination is simply to act as conduit between interested parties. Not withstanding anything found herein, JMHServices follows all local, state and federal laws pursuant to the services delivered over the internet and directly related to our network and internal systems. The purpose of the acceptable use policy is to inform all Customers of anticipated customer use. Due to the myriad of possibilities in maintaining a network comprised of thousands of servers, this document is intended to act as a guideline to service and not to be all encompassing
Server Content: JMHServices does not actively monitor dedicated server content for review. We believes in the free dissemination of information via our services
Peer to Peer: JMHServices allows the use of internet peer to peer software for file sharing purposes. We do highly recommend strict oversight and management of peer to peer software environments due to the propensity to violate copyright law by sharing commercial software or copyright protected material.
BitTorrent: JMHServices allows the use of bit torrent protocols on the public network. We do highly recommend strict oversight and management of Bit Torrent software environments due to the propensity to violate copyright law by sharing commercial software or copyright protected material. NOTE: BitTorrent use is not allowed on base hosting packages, the minimum hosting package we allow Bit Torrent use is reseller-1. Customers using BitTorrent protocol on lower packages are subject to termination without refund or warning. BitTorrent use is limited to 1 (one) tracker per reseller account. Due to the high load caused by trackers any customer that is deemed excessive load will be asked to either upgrade to a dedicated server or terminate their account.
Electronic Signature: Acceptance of the Master Service Agreement incorporating the Terms of Service and Acceptable Use Policy hereby initiates billable services and is deemed complete by agreement to the terms as described on the online signup form(s) and completion of the ordering process.
Disclaimer: JMHServices retains the right, at its sole discretion, to refuse service to any individual, group, or business. JMHServices also retains the right to discontinue service without notice for repeated violation of the acceptable use policy over time.
These TOS and AUP may change at anytime without notice please check back regularly for changes. Any changes that effect current customers will be given till the end of their current term to come within compliance of any changes.
